By purchasing goods from Floraselect.net you are entering a legally binding agreement with us on the following terms. You should read these terms carefully as they affect your legal rights.
Definition of words used in the contract:
‘Terms & Conditions’ means the contract of the sale and purchase of goods between yourselves and FloraSelect.net
‘Trade Customers’ are those who have completed the form to be a trade customer on the website or are buying products for use in correlation with your business, trade, profession or craft.
‘Delivery Area’ means Mainland UK excluding the Isles of Jersey and Guernsey. Please note there will be extra charges for any deliveries offshore- excluding the Isle of Wight, Scottish Highlands, Scottish Islands, Isle of Man and Northern Island.
‘Goods’ means the planters and accessories that are available for sale on the FloraSelect Website.
‘The Website’ means our address which is www.floraselect.net
‘You’ or ‘Your’ or ‘Consumer’ means the buyer of our goods.
Section 1: General Condition of Sale
Making a purchase
1.1 A contract is made for us to sell you goods when we accept an order from you, made via our Website.
1.2 To make a purchase simply browse through the site, adding to the cart any items you may wish to purchase. Once you have finished your order click on View Cart, agree to the terms and conditions and Proceed to Checkout.
It is important that these details are filled in correctly and fully for delivery purposes.
1.3 Orders are accepted if goods are available and your credit or debit card is authorised for the transaction.
1.4 All orders and payments are acknowledged by email.
1.5 We will charge your credit or debit card account for payment on receipt of your order. We accept no liability if a delivery is delayed due to incorrect payment details.
1.6 Your card processing is secured and powered by World Pay, which provide high levels of internet and physical security to ensure sensitive information is never compromised. If you pay using Apple Pay and PayPal, they have their own security features to protect any transactions. We only accept pounds sterling.
1.7 We will take reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access. This is including any personal information, credit card and account details that you provide when accessing or ordering from this Website, unless this is solely due to our negligence.
Section 2: Delivery Schedule
2.1 Our delivery charge for mainland UK are as follows:
- We charge a standard flat rate of £8.50 for mainland UK and for larger items £50 to £120.
- If the goods are shipped from abroad, depending on their size, the standard rate may range from £30-120.
- The charges will be detailed on the order page and will be included in the total price.
2.2 Pallet Delivery
We charge between £50.00 and £120 for the larger planters and for all the terracotta, this charge will be detailed on the order page and will be included in the total. Deliveries are kerb-side and made by a one-manned delivery unit. It is essential that you make arrangements to safely off-load the goods when receiving the delivery. We recommend that only able bodied persons assist with delivery. Where a delivery date has been agreed with our carrier but the customer is not present to receive the delivery a redelivery charge will apply. The amount will depend on the size of the order and courier used.
For orders outside the UK mainland please call us to confirm the delivery cost.
2.3 We will deliver the goods to the address you specify for delivery of your order. It is important this address is accurate and where possible the goods are signed for. If the goods cannot be signed for on delivery please leave specific instructions where you wish the goods to be left on the Delivery Instruction Box when you place your order or we will specify them to be left safe. Any leave safe instructions will be your responsibility.
2.4 Delivery Instructions
It is important that we deliver first time around, therefore please give us specific instructions as to where an item may be left in the event that you are not home, or instruct us to leave with a specific neighbour.
2.5 Please allow up to 15 working days for some items to be delivered. For example our garden edging is only packed at the weekend so delivery may be a bit longer than predicted. In the majority of cases delivery will be a lot quicker. If delivery is delayed due to causes beyond our control we will extend the delivery time by a reasonable period and contact you with the new arrangements.
2.6 We cannot accept any liability for any loss or damage to the goods once they have been delivered.
2.7 Our deliveries are carried out by a third party contractor. Although we will attempt to deliver on the arranged schedule we cannot be held responsible for any transport delays that may occur that are outside of our control.
Section 3: Damaged items
3.1 On a rare occasion, items may become damaged in transit despite the considerable experience of our dispatch team and couriers. Before you sign for the goods, please inspect them to ensure that they have arrived undamaged. We pack our goods extremely carefully and damages are rare, however, once you have signed for the goods it may not be possible to prove that the damage occurred before they came into your possession. If the goods are left without a signature, please make sure you contact us within 24 hours of the delivery taking place to notify us of any damages or shortages.
3.2 Damages correctly notified will be replaced free of charge. However if you choose to cancel the order at that point rather than accept a free replacement, you must return the goods to us at your expense.
Section 4: Cancellation Policy and Returns Policy
4.1 You can cancel your order at any time prior to dispatch. If you would like to return, you have 14 working days to return the items after receiving them. You will be responsible for the return of the goods to us in the condition in which they were sent. We will not pay for the goods to be returned to us.
4.2 To receive a full refund, please notify us on our email or phone number that you are returning your goods. Goods must be returned in the same packaging, in their original condition, undamaged and unused. Goods must be returned to Unit 26, Reeds Farm Estate, Writtle, Chelmsford, Essex, CM1 3ST.
4.3 Goods must be returned using a tracked service and using our phone number (07855 323524) or email address ([email protected]) as the contact. Please take out insurance on the parcel for your protection, as we are unable to refund if any damages occur.
4.4 The couriers Evri and Yodel cannot find our offices, so please use a different courier. Once returned in good order we will issue a refund.
Section 5: Bespoke items
5.1 If we are supplying a bespoke item which is subject to any specification such as size, colour or texture, you are responsible for making sure these specifications are correct.
5.2 We do not offer returns or refunds on bespoke items or items modified from standard specifications as they are made to your requirements.
Section 6: Trade customers
6.1 Business to business or ‘Trade’ transactions do not have the same rights as consumers.
6.2 We do not accept returns from trade customers or give refunds to trade customers unless the goods are damaged on arrival, as per section 3.
Section 7: Accuracy
7.1 We do our best to make sure our website is up to date however there may occasionally be human errors. This may involve inaccuracies, omissions within product descriptions, shipping descriptions or pricing.
7.2 This may involve showing products in stock when they unfortunately may be out of stock. We will contact you as soon as we are aware of this issue if this is the case.
